Terms of Service

Please read these terms carefully before using our service.

These Terms of Service ("Terms") govern your access to and use of Thumbnail Face. By creating an account, accessing, or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and have the authority to accept these Terms.

2. Account Registration and Security

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must promptly notify us if you suspect unauthorized access.

3. The Service

Thumbnail Face is a SaaS product that allows users to:

  • Upload images of faces
  • Select from pre-defined expression templates or provide YouTube video URLs
  • Generate new images with swapped facial expressions using AI technology
  • Download the generated images for use in thumbnails and other content

We may add, change, or remove features at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

4. User Content

A) Your rights

You retain ownership of the images you upload ("User Content") and the images generated from your uploads.

B) License to operate the Service

You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display your User Content only as necessary to operate, maintain, and improve the Service, and to provide the features you request (including AI-based expression generation).

C) Your responsibilities

You represent and warrant that:

  • You have all rights necessary to upload and use your User Content, including the right to use any person's likeness depicted in the images.
  • Your User Content does not violate laws or third-party rights (including privacy, publicity, and intellectual property).
  • You will not upload images of individuals without their consent or in violation of their rights.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent purposes
  • Upload content that infringes intellectual property or violates privacy/publicity rights
  • Create deepfakes or manipulated media intended to deceive, defame, or harm others
  • Upload sexually explicit, violent, or otherwise objectionable content
  • Use the Service to harass, bully, or intimidate any person
  • Attempt to gain unauthorized access to systems or accounts
  • Interfere with or disrupt the Service (including abuse of rate limits)
  • Reverse engineer, scrape, or probe the Service except where permitted by law
  • Use automated tools to access the Service without our permission

We may suspend or terminate accounts that violate these Terms.

6. Credits System

A) How credits work

The Service uses a credit-based system for image generation:

  • New users receive 3 free credits as a welcome gift.
  • Each expression generation using a template costs 1 credit.
  • Each expression generation using a YouTube URL costs 2 credits (due to additional AI analysis required).
  • Credits are deducted when a generation task is initiated.
  • If a generation fails due to a system error, credits will be automatically refunded.

B) Purchasing credits

Additional credits can be purchased through the Service. Credit packages and pricing are displayed at the time of purchase.

C) Credit expiration

Credits do not expire as long as your account remains active.

7. Fees, Payments, and No Refund Policy

A) Credit purchases

Credit packages are available for purchase. Prices and package details are shown at checkout.

B) Payment processing

Payments are processed by Creem. You authorize Creem to charge your payment method for applicable fees and taxes.

C) No refunds

All credit purchases are non-refundable and we do not offer refunds for purchased credits, except where required by applicable law. This is because credits can be used immediately upon purchase and the digital nature of the service makes it impractical to verify whether credits have been used.

D) Failed generations

If an image generation fails due to a technical error on our end, the credits consumed for that generation will be automatically refunded to your account.

8. Third-Party Services

The Service may rely on or integrate with third-party services (e.g., Creem, Umami, Sentry, Convex, AI model providers). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services outside our control.

9. Intellectual Property

  • The Service, including its design, features, and underlying technology, is owned by Thumbnail Face and protected by intellectual property laws.
  • You may not copy, modify, distribute, or create derivative works of the Service without our permission.
  • Expression templates provided by the Service are for use within the Service only.

10. Suspension and Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service's integrity and security.
  • Upon termination, your right to use the Service stops immediately.
  • Unused credits are not refundable upon account termination.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the quality, accuracy, or suitability of generated images for any particular purpose.

AI-generated expressions may differ from our preset templates or your YouTube-based thumbnails. You may need a few attempts to reach your ideal result.

12. Limitation of Liability

To the maximum extent permitted by law:

  • We will not be liable for indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim arising out of or related to the Service will not exceed the amount you paid to us for credits in the past 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so these limitations may not fully apply to you.

13. Indemnification

You agree to indemnify and hold harmless Thumbnail Face, its affiliates, and its personnel from claims, liabilities, damages, and expenses arising from your use of the Service, your User Content, or your violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. We will post updated Terms on thumbnailface.app and update the Effective Date. If changes are material, we may provide additional notice. Continued use of the Service after changes become effective constitutes acceptance.
